The defendants, Carlo Franco and Edward Sanchez, were placed under arrest on May 27, 2004. On June 4, 2004, the grand jury indicted and charged the defendants with murder in the second degree (Penal Law § 125.25 [3]), robbery in the first degree (Penal Law § 160.15 [2]), and criminal possession of a weapon in the second degree (Penal Law § 265.03).
