Julius M. Bennett was driving north on highway No. 37 in Sanborn County on the 14th day of September, 1932, at about 7:15 o’clock in the evening. G. E. Basham was driving south on the same road at the same time. The cars operated -by these two drivers came together in a head-on collision, and both drivers were killed; neither regaining consciousness after the accident. No one was in either car except the driver. This action was -commenced by the plaintiff, who is the administrator of the estate of Julius M.
