MEMORANDUM OPINION AND ORDER
GEORGE HOWARD, Jr., District Judge.
Pending before the Court is defendant Jim Guy Tucker’s (Tucker) motion for a new trial. Tucker, the Governor of Arkansas until his conviction, was indicted on eleven counts in a twenty-one count indictment. He was convicted on May 28, 1996, of conspiracy involving the misuse of the funds of Madison Guaranty Savings and Loan, and Capital Management Services, a small business investment company. He was also convicted of mail fraud in connection with a loan from Capital Management Services to Castle Sewer and Water Corporation.
