MEMORANDUM OPINION AND ORDER

GEORGE HOWARD, Jr., District Judge.

Petitioner Jim Guy Tucker (“Tucker”) has filed a motion to vacate his sentence under 28 U.S.C. § 2255. On August 17, 1995, a grand jury in the Eastern District of Arkansas indicted Tucker along with James McDougal and Susan McDougal in a twenty-one count indictment, of which Tucker was indicted on eleven counts. At the time of the indictment, Tucker was the Governor of the State of Arkansas.
