On 2 August, 1928, the Treasurer of North Carolina instituted an action in the Superior Court of Wake County against Mecklenburg County and the Mecklenburg Highway Commission. It was alleged in the complaint that the defendant, Mecklenburg County, was a body politic and corporate, and authorized to sue and be sued.
