This is an action in trespass by Frances Harlow and Carey Harlow, her husband, for damages sustained by reason of the invasion of the wife plaintiff’s right of privacy. The violation consisted of the unauthorized use of her photograph for *102commercial purposes. Plaintiff Carey Harlow suffered a voluntary nonsuit at the trial. The jury found in favor of plaintiff, whereupon, defendant filed these motions for judgment n. o. v. and new trial.
