The defendant Albert G. Spalding demurs to the complaint herein upon the grounds that this court has not jurisdiction of the subject of the action; that the defendants have not legal capacity to sue; that there is a defect of parties plaintiff; that there is a defect of parties defendant, and that the complaint does not state facts sufficient to constitute a cause of action.
