This matter comes before the court on the appeal of F. Perry Smith (“Smith”), pursuant to 28 U.S.C. § 158(a), from an order of the United States Bankruptcy Court for the Eastern District of Virginia granting summary judgment in favor of the trustee for the debtor, Public Access Technology.com, Inc.
