The only question to be determined by this Court in this case at this time is, what action it should take upon the motion of the-Attorney-General to dismiss the writ of error allowed in this case, upon the ground that the plaintiff in error has escaped from custody, since the writ of error was allowed to the judgment of sentence of the circuit court of Ohio county, and is still at large. So -far as I am advised, this is the first time the question involved in said motion has been presented to this Court for decision.
