Appeal from Pike Circuit Court. Tried before Hou. John P. Hubbard. Motion in this court to dismiss the appeal, on the ground that the appellant had escaped from custody, and was a fugitive from justice, as shown by affidavits.

— In November, 1883, the defendant was convicted of the crime of murder in the first degree, for which he was sentenced to the penitentiary for life. The present appeal is prosecuted from this judgment, and since the filing of the transcript it is made to appear to the satisfaction of the court, that the accused has unlawfully escaped from the custody of his jailer, and is now a fugitive from justice.
