This case is before this Court on an original petition for habeas corpus filed by Thurman Franklin Dye.

Thurman Franklin Dye was convicted of armed robbery by a jury in Lewis County on March 20,1980. On March 26, 1980, the petitioner was sentenced to twenty-five years imprisonment at the West Virginia State Penitentiary in Moundsville. On April 2, 1980, the petitioner filed an application for a postponement of execution of his sentence with the circuit court. A postponement of sixty days was granted.
