The defendant was convicted of a violation of the statute, now Section 74, 2 Code 1922, the provisions of which are as follows:
“Whoever shall willfully, unlawfully, and maliciously cut, mutilate, deface, or otherwise injure, any tree, house, outhouse, fence, or fixture of another, or commit any other trespass upon real property in the possession of another, shall be guilty of a misdemeanor, and upon conviction thereof, shall be fined and imprisoned, at the discretion of the Judge before whom the case shall be tried: Provided, that…
