MEMORANDUM AND ORDER

JOYNER, District Judge.

This is an action filed by plaintiff, Joseph N. Lazzaro, for an alleged violation of the Age Discrimination in Employment Act of 1967, as amended, 29 U.S.C. § 621 et seq. (“ADEA”), by his former employer, the Franklin Mint Company. At issue before the Court is defendant’s motion for summary judgment filed pursuant to Rule 56 of the Federal Rules of Civil Procedure.
