OPINION

Appellants, Patrick O’Brien Murphy a/k/a O’Brien Murphy and Beverly Murphy, appeal from the trial court’s Final Judgment and Order Granting Defendants’ Motion for Summary Judgment. We affirm in part and reverse and remand in part.

Factual and Procedural Background

In 2005 appellants wanted to refinance their existing home mortgage and began seeking out potential lenders. This process was complicated by the fact that appellants had a personal bankruptcy on their credit history. Appellants eventually chose appellee, Wells Fargo Bank, N.A.…
