I. STATEMENT OF CASE

Pursuant to verdict, the defendant-appellant, Sydney L. Thieszen, was adjudged guilty of and sentenced for committing a first degree murder, in violation of Neb. Rev. Stat. § 28-303 (Reissue 1995), and for using a firearm in the commission of a felony, in violation of Neb. Rev. Stat. § 28-1205 (Reissue 1989).
