This is an action of replevin begun March 31, 1938, for the recovery of certain paint sold by plaintiff company to defendant Rechter on open account. It appears that defendant Rechter opened a new business for the sale of automobile accessories, floor coverings, paint and similar articles of merchandise in the city of Jackson in September, 1937. Prior to that time he had been the manager of a store selling similar merchandise. He invested about $1,200 in the store when he opened for business.
