Beals, J. —

King county, a municipal corporation, and James L. Napier, as plaintiffs, instituted this action-before the superior court for King county, asking a decree quieting King county’s title to certain real estate. The first amended complaint (hereinafter referred to as the complaint) alleged that August 31, 1938, King county instituted a general tax foreclosure action against all real estate within the county upon which the taxes for the years 1930 and 1931 were unpaid.
