This case is before the court on defendant’s motion for summary judgment, requesting dismissal of the complaint.

For its first cause of action plaintiff, E. H. Marhoefer, Jr., Co., alleges that it entered into a contract with defendant, Mount Sinai, Inc., on December 15, 1954, whereby it agreed to act as a general contractor in the construction of an addition to the existing building of defendant’s hospital, and that plaintiff performed the services and supplied the materials required of it and completed said contract.
