The facts presented by this appeal are:

Otto and Frank Mattuschek are bachelors, owners of and reside on a ranch in Fergus County, Montana, consisting of about 3,540 acres. For many years past they have operated the ranch as a grain and stock enterprise.

E. F. Carnell is a licensed real estate broker at Lewistown, Montana, the county seat of Fergus County. Having heard that the Mattuscheck ranch might be for sale, he drove out to the place on or about May 14, 1953, and talked to the Mattuschek “boys”. As a result of that conversation the following…
