Chambers v. Aetna Casualty & Surety Co.
Superior Court of Pennsylvania
1Opinion of the Court
POPOVICH, Judge:
This is an appeal from the order of August 18,1994, entered in the Court of Common Pleas of Allegheny County. Herein, we are asked to determine whether the lower court erred in finding that appellant was not entitled to underinsured motorist coverage from appellee, Aetna Casualty and Surety Company (“Aetna”), because appellant did not exhaust the policy limits of available liability insurance. Upon review, we vacate the lower court’s order and permit appellant to assert a claim for underinsured motorist coverage.
