The plaintiff recovered judgment for three hundred dollars damages for the violation of a building restriction. The defendant appeals from the judgment and from an order denying his motion for a new trial.

The parties are owners of adjoining lots in block A of West Park Tract in the city of Los Angeles. The plaintiff acquired her lot, No. thirty-eight, in 1907. Lot thirty-nine was purchased by the defendant in 1909.
