INTRODUCTION
CHARLES R. RICHEY, District Judge.
Before the Court in the above-captioned case are the defendant’s Motion to Dismiss or, in the alternative, for Summary Judgment and the 'plaintiffs Opposition thereto. The Court heard oral arguments at a pretrial conference on November 14, 1996. Based on the arguments, the pleadings, the entire record herein, and the law applicable thereto, the Court granted summary judgment for the defendant. 1 The Court shall more particularly set forth the basis for its ruling in the present Memorandum Opinion.
