HAIGHT, Circuit Judge.

The defendant in error, who is the widow of one John A. De Busley, deceased, brought suit in the court below against the plaintiff in error, and recovered a judgment for the .damages which she and two minor children suffered by reason of the death of her husband. He was killed, under the circumstances hereinafter detailed, by an engine belonging to and under the control of a crew in the general employ of the plaintiff in error.
