THIS CAUSE arises before the Court upon Defendant United States Customs Service’s (“Customs”) motion to dismiss plaintiff’s complaint.
The plaintiff, Dalia Faldraga, instituted this action on April 9, 1987, alleging two grounds for the return of her vessel. As to her first claim, plaintiff alleges that the length of time of the vessel's seizure constitutes a violation of her due process rights under the fifth amendment.
