OPINION OF THE COURT

Fletcher, Chief Judge:

After drinking for several hours in an enlisted men’s club at Camp Pendleton, California, the appellant and several of his companions began walking toward a neighboring community when they were accosted by a Marine named Quarles. The testimony of the various witnesses at trial, including Private Quarles’ companion, is consistent with respect to the events which preceded the fatal stabbing of Private Quarles by the appellant.
