This is a suit instituted by plaintiff, Jack Lavergne, against his employer, Joe Fran*768cois, d/b/a Whole Builders, and his insurer, Home Indemnity Company, under the Workmen’s Compensation Act for total and permanent disability as a result of an accident and resulting injuries received by plaintiff on April 3, 1963, which occurred in the course of his employment for Wholesale Builders. Plaintiff alleged that as a result of the accident he suffered from severe pain in the neck and is unable to use his right arm. He also asked for penalties and attorney’s fees. Defendants filed an…
