BLACKBURN, Presiding Judge.

Following a jury trial in this declaratory judgment action concerning insurance coverage, Government Employees Insurance Company (GEICO) appeals the trial court’s grant of a new trial, arguing that the trial court erred in concluding that the special verdict form (which resulted in a judgment in favor of GEICO) was defective. Progressive Casualty Insurance Company cross-appeals the trial court’s denial of its motion for directed verdict, arguing that GEICO failed to meet the prerequisites for bringing a declaratory judgment action.
