WALKER, Chief Justice.

This was a workman’s compensation case. Estelle Oil Company was the employer, J. W. Burnett the employee, and appellant, Texas Employers’ Insurance Association, the compensation insurance carrier. On August 26, *7431930, while in the course of his employment, Burnett was struck on the forehead by a piece of iron piping, from which he suffered a severe injury. His claim for compensation was regularly prosecuted to the Industrial Accident Board, from which appeal was regularly prosecuted to the district court of Jefferson county, where a judgment, on the 8th day of April,…
