MEMORANDUM

PENN, District Judge.

This matter is before the Court on plaintiffs Rule 60(b)(2) Motion Regarding Newly Discovered Material Evidence [# 99]. For the reasons set forth below, plaintiffs Rule 60(b)(2) motion is denied.

BACKGROUND

A. Procedural background
