The exception is to a judgment refusing the defendant’s motion for a new trial, complaining of a verdict finding him guilty of murder. The case was before this court on a former occasion. King v. State, 163 Ga. 313 (136 S. E. 154). The report of that case shows the circumstances of the killing as they appeared at the former trial. The reversal of the judgment resulted in the grant of a new trial. The facts upon the second trial sufficiently appear in the former report of the case and from the following divisions of this decision.
