Grounds seventeen to twenty-two, inclusive, complain of the admission of evidence. Referring to the time of making the arrest of defendant at his home three hours after the homicide, the sheriff was permitted to testify: “At the time I told him to put on his clothes and come with me, he said, ‘I can prove by Mr. Walter Craig and Mr. Dock Torbet I have been here all night/” The objection urged was that this evidence was irrelevant, immaterial, and inadmissible, for the reason that it was neither a part of the res gestae nor a confession; The sheriff was permitted to testify also: “I knocked at…
