Appeal from a judgment of the superior court for Spokane county, Sullivan, J., entered August 5, 1916, upon sustaining a demurrer to the complaint, dismissing an action for damages, tried to the court.

— This is an action for damages. A demurrer to the amended complaint having been sustained and the plaintiff declining to plead further, a judgment was entered dismissing the action. The plaintiff has appealed.

The essential allegations in the complaint are, that the respondent is, and at all times hereafter stated was, a national bank doing business in the city of Spokane; that it has from the beginning been the custom of all banks, including the respondent, to receive and accept wills for safe-keeping, to be delivered as directed upon the death of a testator; that Enos S.
