I. Introduction

In August 2007, a jury found Robert Brooks guilty of one count of second degree murder and one count of armed criminal action. He was sentenced to life imprisonment and 75 years to be served concurrently.

On appeal, Brooks alleges the trial court erred in allowing comments and testimony about Brooks’ failure to provide an exculpatory statement to police after being advised of his Miranda rights.
