This matter is before the Court on the motion for summary judgment filed by defendant Unum Corporation (“UNUM” or “defendant”) pursuant to Rule 56 of the Federal Rules of Civil Procedure and the cross motion of Arlene Tavares (“Tavares” or “plaintiff’) for partial summary judgment.
