— Affirming.
At about 6:15 o’clock on tbe morning of December 13, 1912, tbe body of appellant’s intestate, George Bell, was found lying near appellee’s eastbound track, about 300 feet east of the South Manchester depot, in Lewis county. His bead was lying near tbe cross-ties, with bis feet extended towards tbe hillside. Tbe back of Bell’s bead was crushed, bis neck broken, and there were a few scratches on bis face and body.
Bell was a section laborer in tbe service of tbe appellee.
On tbe night in question bis work was that of a watchman, bis particular duty…
