Reversing.
About nine o’clock on the night of April 26, 1913, Arthur Erogg, a young man about twenty years of age, was killed near the railroad depot at Pine Knot. His administrator instituted this action in the McCreary Circuit Court against the Cincinnati, New Orleans & Texas *7Pacific Railway Company to recover damages for his death, and obtained a verdict and judgment in the sum of five thousand dollars. The railway company appeals.
