MEMORANDUM AND ORDER
McLAUGHLIN, District Judge.
This action is before the Court on cross-motions for summary judgment pursuant to Fed.R.Civ.P. 56. For the reasons set forth below, plaintiff's motion is granted and defendants’ motion is denied.
FACTS
I. BACKGROUND
The United States of America brings this action against defendants for violations of § 211 of the Clean Air Act, 42 U.S.C. § 7545, and the Unleaded Fuels Regulations promulgated thereunder, 40 C.F.R.
