Appeal from a judgment of the Supreme Court (Relihan, Jr., J.), entered January 19, 1993 in Tompkins County, upon a decision of the court in favor of plaintiff.

Plaintiff commenced this action to recover damages for the expense of remedying the effects of a motor fuel spill at plaintiff’s above-ground fuel dispensing facility. Defendant Tokheim Corporation manufactured a regulator used in the system. Defendant Clemett & Company, Inc. designed the system and provided the parts.
