MEMORANDUM AND ORDER
STUART, District Judge.
This matter is before the Court on a motion to dismiss filed by defendant Eagle Iron Works (Eagle). Because Eagle has offered several exhibits in support of the motion, the Court will treat it as a motion for summary judgment under F.R.Civ.P. 12(b) and 56.
The most recent charge filed against Eagle with the Equal Employment Opportunity Commission (EEOC) alleging a violation of Title VII of the Civil Rights Act of 1964, as amended, was filed by Ira Hicks, February 17, 1969, alleging a violation occurred on October 31, 1968.
