The matter presently before the Court is plaintiffs motion to stay an arbitration proceeding. Plaintiff, A.T. Cross. Co. (“A. T. Cross”), has filed suit seeking a declaratory judgment that it is not subject to arbitration proceedings initiated by defendant, Royal Selangor(s) PTE, Ltd. (“Royal Selangor”). Plaintiff contends that the arbitration clause in the alleged contract was never agreed to by the parties and therefore is not enforceable.
