Mandamus. Relator applied for mandamus to compel respondent to enter an order restraining the use' of certain evidence, claimed to have been secured through an abuse of process. The facts are stated in the opinion.

Relator is garnishee defendant in a cause pending in the Muskegon circuit court, in which Samuel Rosenwald, Julius Rosenwald, and Julius Weil are plaintiffs, and Sol Rosenthal and Sam Rosenthal are the principal defendants. The principal cause was commenced by writ of attachment issued out of the circuit court, and the garnishee proceedings are based thereon.
