On December 17, 1927, one Lester Sheeley and Maud Sheeley, his wife, executed a promissory note in the sum of $825 in favor of Vinton & Tooze, or order, with interest at the rate of 8 per cent per annum. The note was in the usuanl form and provided for reasonable attorney’s fees. On January 11, 1928, Vinton & Tooze indorsed the' note in blank and delivered and transferred the same to Fred W.
