OPINION
WALLS, District Judge.
This matter comes before the Court on the motions of plaintiffs Hoffman-La Roche Inc. (“Roche”) and Syntex (U.S.A.) Inc. (“Syntex”) to voluntarily dismiss their complaint against defendant Genpharm Inc. (“Genpharm”) without prejudice and to dismiss Genpharm’s counterclaims against them for lack of subject matter jurisdiction and for failure to state a claim upon which relief may be granted.
