At issue in this case is whether appellee Commercial Security Bank’s contracts to supply the Ogden City and Weber County, Utah, School Boards with the “no-check” payroll service violate Sections 1 and 2 of the Sherman Act, 15 U.S.C. §§ 1, 2. 1 Appellants Bank of Utah and Bank of Ben Lomond sued Commercial Security alleging the contracts constituted an unlawful restraint under § 1 and an attempt to monopolize under § 2 and seeking treble damage and injunctive relief.
