FORRESTER, District Judge.

This action is before the court on defendants’ motion to dismiss or for summary judgment. By this action plaintiff seeks reinstatement, damages, back pay, and declaratory judgment for defendants’ discharge of plaintiff on October 18, 1977. Plaintiff alleges that the FBI acted arbitrarily and capriciously and in violation of his constitutional rights when it discharged him from his position as special agent, in that the discharge was the result of a conspiracy against the plaintiff which led to the destruction of his career and in that he was discharged in…
