THIS MATTER comes before the Court on Defendant United States of America’s Motion and Memorandum to Dismiss Plaintiffs’ Errata Amended and Consolidated Complaint [Doc. No. 118] Pursuant to Fed.R.Civ.P. 12(b)(1) and 12(b)(6) or, in the Alternative, Motion for Summary Judgment Pursuant to Fed.R.Civ.P. 56, filed February 23, 2012 (Doc. 123)(“Mo-tion”).
