BREAUX, J.
This suit was brought by the late Mrs. Elvia Stothart and husband to *698have a sale of land annulled which she received as a donation from her father. Since the appeal, Mrs. Elvia Stothart died. Her surviving husband, as tutor of the children, was made a party.
In assailing defendants’ title, they, in substance, set out that the firm of William T. Hardie & Co., composed of William T. Hardie, William E. Hardie, and Robert T.
