This case comes before, the court on a motion to intervene. For the reasons set forth below, the motion to intervene is GRANTED.

I. Factual and Procedural History

Defendant Henry LLC of Virginia Beach (“Henry LLC”) owns a thirty-unit residential apartment complex located on 15 1/2 Street, Virginia Beach, Virginia (“Apartments”).
