The plaintiff in error filed a petition for certiorari in the superior court of Fulton county. When the case was called for trial, counsel for the defendant in certiorari moved the court -to dismiss the same, upon the ground that the certiorari bond was signed, “New York Life Insurance Company, by E. J. Clark, supervisor,” and it did not affirmatively appear from the record in *26the ease that said Clark had authority to sign the name of the company to the bond. The judge of the superior court sustained this motion and dismissed the certiorari, and exception is taken thereto.
