WADDILL, Circuit Judge.
These are two actions for malicious prosecution, one by R. E. Greene and the other by R. B. Greene, against J. W. Blakely and the Peerless Steam Laundry Company, a corporation. The parties will be referred to by their titles in the District Court. The two Greenes were brothers, and were both formerly employed by the Peerless Steam Laundry Company. The two eases were instituted in the United States District Court for the Southern District of West Virginia, at Bluefield, and the facts in both are substantially the same.
